If you wish to count Tom as a Valar, that is your right, but the bottom line is, there is nowhere in Tolkien's work that states that Tom was a Valar who lived in a house a short distance east of the Old Forest in Middle-earth. Tolkien himself dismissed questions regarding Tom Bombadil, as I am sure you are aware, and never stated that he was anything other than an enigma.

Even in a mythical Age there must be some enigmas, as there always are. Tom Bombadil is one (intentionally). The Letters of J.R.R. Tolkien, Letter 144

I enjoy playing this game using the facts from the books and learning more about Tolkien's works. If we have to start making guesses based on assumptions, contrary to what the rules state in the original post (OP), rather than relying on facts, it makes the game unfair.
